Energy saving lamps: Antidumping duty on Chinese energy saving lamps
The Danish Minister for Environment and Energy, Svend Auken, wrote letters to EU-commissioners Loyola de Palacio and Margot Wallstr鳇 on 2 May 2001 drawing their attention to the serious consequences for EU climate and energy policy targets of a prolongation of the penal duty on Chinese energy saving lamps. He also asked them to exercise their influence in the course of the Commission抯 internal procedures to ensure that the important Community interest aspects concerning energy and environmental objectives are taken fully into account before any decision of the Commission is taken.

As from February 8 2001, the European Commission has introduced a temporary duty on CFLs (compact fluorescent lights) imported from China. The duty has been introduced because of a claim of dumping made by the European Lighting Companies Federation, which encompasses European producers such as Osram, Sylvania and Philips. The duty is between 0 and 74.4% of the production price of a CFL.

Before 8 August 2001 the Council of Ministers is to confirm or invalidate the Commission抯 decision, which will then be valid for five years. The Commission has received broad backing to introduce a temporary penal duty and significant efforts will be needed to change the attitude of the Commission and the Member States.

An anti-dumping duty on CFLs produced in China will mean:

Higher prices for European consumers as a result of the duty and less competition

The growth in sales of CFLs will be stopped as a low price of procurement is decisive for the choice made by consumers

The possibilities for the EU to fulfil its CO2-saving targets will be weakened as CFLs are one of the cheapest and most efficient forms of energy saving.

The Commission抯 investigation of the matter is inadequate. The most important defects are that:

The cause of the growth in sales of CFLs on the European market has not been investigated

The choice of Mexico as a country of comparison with China is inappropriate

Different qualities of CFLs are compared

A lack of competition in the European industry has not been included in the assessment.
